Welcome to K53 Sharp! These Terms of Service ("Terms") govern your use of the K53 Sharp mobile application ("App") provided by Crafted Bits ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. License to Use

1.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use in preparing for the South African K53 driving test.

1.2 Restrictions

You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Use the App for any commercial purpose
  • Remove or alter any proprietary notices or labels
  • Use the App in any way that violates applicable laws

2. Intellectual Property

2.1 Ownership

The App, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, and software), is owned by Crafted Bits and is protected by South African and international copyright, trademark, and other intellectual property laws.

2.2 Content

The learning materials, including road signs, rules of the road, and vehicle controls information, are provided for educational purposes to help you prepare for the K53 test. While we strive for accuracy, this content should be used as a study aid alongside official K53 materials.

The educational content in this App has been compiled and adapted from official South African government sources, including:

We do not claim ownership of the underlying road traffic laws, regulations, or sign specifications, which remain the property of the South African Government. The App presents this information in an educational format to assist learners in preparing for their K53 tests.

3. User Responsibilities

3.1 Acceptable Use

You agree to use the App only for its intended purpose: preparing for the South African K53 learner's or driver's license test.

3.2 Prohibited Activities

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Use automated systems or software to extract data from the App
  • Share or distribute the App's content without authorization

4. Disclaimer of Warranties

4.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4.2 No Guarantee of Results

We do not guarantee that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Using the App will guarantee you pass the K53 test

4.3 Educational Content

The content in the App is for educational and informational purposes only. While we strive to keep the information accurate and up-to-date with South African traffic laws and K53 requirements, we recommend:

  • Consulting official K53 study materials
  • Verifying information with authorized driving schools
  • Checking for updates to traffic laws and test requirements

5. Limitation of Liability

5.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CRAFTED BITS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Any damages arising from your use or inability to use the App
  • Any damages related to your K53 test results

5.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH IS ZERO, AS THE APP IS FREE).

6. Indemnification

You agree to indemnify, defend, and hold harmless Crafted Bits and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable laws

7. Changes to the App

We reserve the right to:

  • Modify, suspend, or discontinue the App at any time without notice
  • Update the App's content, features, or functionality
  • Change these Terms at any time

We will notify you of significant changes by updating the "Last Updated" date and, where appropriate, providing notice within the App.

8. Termination

8.1 Your Rights

You may stop using the App at any time by uninstalling it from your device.

8.2 Our Rights

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.

8.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of South Africa.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crafted Bits regarding the App and supersede all prior agreements and understandings.
